Editorial: EV Rejects Claims in Bach Lawsuit Regarding Lucid as Source of Nov. 12 Report

On Monday,  Lucid Motors‘ former Senior VP Product and Chief Engineer Eric Bach alleged, through his undersigned counsel, Wigdor LLP and Robinson Markevitch & Parker LLP, that Lucid was the source for the report published by EV on November 12 regarding his departure from the company.

The lawsuit, which was filed in the United States District Court for the Northern District of California, states:

“On November 12, 2025, Lucid made negative public statements about Bach to EV, a business blog reporting on the electric vehicle industry. In an obvious effort to lash out at Bach because of his protected activity, Lucid falsely blamed Bach for production delays, significantly damaging his reputation.”

The filing further alleges: “In an attempt to hide its unlawful behavior, upon information and belief, Lucid requested that the publication not attribute the disparaging statements to any Lucid executive but, rather, to an anonymous ‘internal source.'”

These statements are false.

EV‘s reporting on November 12 was based on information provided by a source close to the matter with firsthand knowledge of the situation — not by Lucid Motors or any company representative.

At no point did Lucid contact EV regarding Eric Bach, nor did the company request any specific attribution for the information published.

The November 12 report, which exclusively revealed that Bach had been forced out — a detail now confirmed by the filing itself — included the following:

EV learned that Bach was forced out by the EV maker’s interim CEO Marc Winterhoff.

“Many were surprised it took this long,” an internal source told EV back in November.

Bach was viewed internally as a significant factor behind repeated product delays, with his team failing to establish proper design controls and governance over engineering changes, leading to costly setbacks throughout the supply chain, the person told me — EV‘s founder and the author of the November 12 report, Cláudio Afonso.

The same source said that these missteps created cascading delays that were often attributed publicly to supply chain issues, when the actual root cause was a failure to appreciate lead times and the costs of acceleration when problems emerged.

EV stands by its reporting and its sourcing while maintaining its ambition of providing its readers with the best stories of the electric vehicle industry.

Lucid reacted on Tuesday to Bach’s claims, naming them “absurd.”

In a statement sent to the media outlet TheDrive, the company stated:

“In our opinion, Mr. Bach’s legal claims are absurd. We are confident that the facts revealed through the course of litigation will establish the legitimate issues leading to Mr. Bach’s termination.”

Cláudio Afonso founded CARBA in early 2021 and launched the news blog EV later that year. Following a 1.5-year hiatus, he relaunched EV in April 2024. In late 2024, he also started AV, a blog dedicated to the autonomous vehicle industry.
